Daniel A. Manna

Dan has represented clients in many areas of civil litigation, including securities litigation, construction law, products liability, federal and state consumer law, insurance coverage disputes, statutory health care privacy law, state and federal civil rights, and general commercial litigation.

He has successfully represented some of America’s largest companies in both state and federal civil litigation and private arbitration. Dan has represented clients locally and nationwide, including helping to defeat class certification in a securities fraud action in Nevada, winning summary judgment for a Fortune 50 client in a personal injury matter in Wisconsin, and winning summary judgment for an information technology client accused of violations of statutory confidentiality rules and invasion of privacy. Dan’s practice includes appellate work, and he has helped secure victories in the Wisconsin Court of Appeals, the Supreme Court of Wisconsin, and the U.S. Court of Appeals for the Seventh Circuit.

Appellate

  • Won reversal from Wisconsin Court of Appeals of circuit court decision to impose perpetually rising daily sanction on client, saving client over $1,000,000
  • Won appeal in Wisconsin Court of Appeals affirming summary judgment in favor of client in catastrophic equipment failure litigation and defeated effort to take case to Wisconsin Supreme Court.

Trial

  • Won summary judgment for Costco Wholesale Corporation in action by petroleum marketer claiming that Costco’s gasoline pricing violates the Wisconsin Unfair Sales Act. Also won award of attorney’s fees to be paid to Costco by the plaintiff.
  • Won summary judgment in defense of quarter-million-dollar products liability case involving catastrophic damage to two expensive farm implements. Convinced a Wisconsin circuit court judge to dismiss the case as a sanction for noncompliance with court orders, something the judge had only done once previously in his 23-year tenure on the bench.
  • As the plaintiff’s counsel in federal breach of contract and declaratory judgment suit, forced settlement for full amount of client’s damages plus full amount of client’s attorney fees and costs in both the federal action in Wisconsin and a separate federal suit in Kentucky.
  • Defeated summary judgment motion and motion to dismiss and won sanctions motion, all in the same hearing. Sanctions win significantly increased leverage against primary defendants, which led to a highly favorable settlement for clients shortly thereafter.
